A financial settlement is the legal process that determines what financial position each party is in after a relationship ends. It Is Separate From Divorce

One of the most important things to understand is that a financial settlement and a divorce are two completely separate legal processes. The divorce order dissolves the marriage. Once the divorce order takes effect, married couples have twelve months to commence formal financial settlement proceedings. De facto couples have two years from the date of separation. Missing these deadlines without a court order granting an extension can mean losing the right to make a claim.

Everything Goes Into the Pool

The financial settlement process begins by establishing the complete asset pool. This covers all assets and liabilities held by either party regardless of whose name they are in. The family home, investment properties, superannuation, savings, businesses, trusts, vehicles, and all debts are included. Superannuation is treated as property under Australian family law and can be divided through a superannuation splitting order. For many couples, particularly those who have been together for a long time, superannuation is one of the most significant assets and one that is frequently underestimated in early negotiations.

The Division Is Based on Contributions and Future Needs

Australian law does not apply a 50/50 split by default. The court assesses each party’s financial contributions, including income and assets brought into the relationship, and non-financial contributions, including homemaking and parenting, alongside each party’s future needs. Future needs factors include earning capacity, age, health, and the ongoing care of children. This framework means the outcome varies case by case, and the quality of the legal advice and advocacy you receive directly affects where your settlement lands within the possible range.

Getting the Outcome Documented Properly

Once a financial settlement is agreed, it should be formally documented through consent orders or a Binding Financial Agreement. An informal arrangement provides no legal protection if one party later decides not to honour it. Drafting these documents correctly matters as much as reaching the agreement itself.

How Most Settlements Are Reached

The majority of financial settlements in Australia are resolved through negotiation or mediation rather than court proceedings. This is generally faster, less expensive, and gives both parties more control over the outcome than having a judge decide. Once an agreement is reached, it should be documented through consent orders or a Binding Financial Agreement. Consent orders are approved by the court without a hearing in most cases and make the agreement legally enforceable. A Binding Financial Agreement is a private contract that takes effect without court involvement but must meet strict legal requirements to be valid.
